Email Marketing Compliance

So you’re ready to hit the ground running with your first email campaign? Have you considered State, Federal and overseas privacy and spam regulation? Here at Emailezy we know all about the legal regulations so you know we have your back.

Get up to speed with the Australian Privacy Act & Spam Act 2003

We don’t want you to have to trawl through legal jargon just to feel confident to send your first email. We’ve broken it down so that all you have to do is put it into practice. As an email marketer here are the 4 most important things you should do to ensure you are compliant with the Australian Privacy Act:

    1. Make sure you have your own privacy policy in place
    2. Only collect information you require
    3. Ensure you are Spam Act Compliant
    4. Consider where and how your data is stored

Maintaining Your Privacy

We have no direct relationship with your subscribers, thus you’re responsible for making sure you have the appropriate permission for us to collect and process information about those individuals.

By using our services, whether it’s consulting our support team, making an enquiry, or any other form communication with us, you are providing us with information that we can keep. This may include your name, address, email address and billing details. Using Emailezy ensures this information is kept secure.

Collect Relevant Information

Only ask for relevant information from subscribers, this may be as simple as a name and an email address.

Spam Compliance

There are 3 key things to remember with spam compliance:

    • Consent - The email recipient must have given permission
    • Identify - Email recipients have to know where it’s come from
    • Unsubscribe - You must provide an opt-out option

You must have consent

You must obtain consent in order to comply with The Spam Act (2003). This can be gained via a confirmation email.

You must identify yourself in the email

To act in accordance with spam compliance laws you must always identify who the email is from on your email. Ensure that you include your business address details on each email you send which includes; your company name, contact details and address information.

Subscribers must be able to opt-out and you must respect this

Provide a clear and obvious way for readers to unsubscribe to your list. Emailezy automatically unsubscribes people from a link provided in the email, however, if they contact you directly you must honour this request within 10 days of the initial request. Not complying with this can land you in hot water.

Data Storage

We keep your data local

The Australian Privacy Act has recently strengthened requirements for cross border disclosure of personal information. By using Emailezy you have peace of mind knowing that all of your personal data and the data of all your contacts will be stored securely here in Australia.
